The revocation, suspension, or modification of a commercial driver's permit or certificate of convenience and necessity shall proceed in accordance with 4.1036 ASCA, which provides for the giving of reasonable notice of facts or conduct which warrant the intended action and an opportunity to show compliance with all requirements for the retention of the license. However, should the commission find that the public health, safety, or welfare require emergency action and incorporates such finding in its order, the commission may order a summary suspension of the commercial driver's permit for a period not to exceed 120 days, pending revocation proceedings or other action.History: Comm.
